Telangana HC stays eviction of landowners in Khajaguda, – Homevior

HYDERABAD: Telangana high court on Tuesday came down heavily on HYDRAA commissioner AV Ranganath and warned that it may summon him once again for being in a hurry to demolish properties, claiming that they are in full tank level (FTL) area of Thavutoni (Bhagirathamma) Kunta at Khajaguda. The court also stayed dispossession (eviction) of three petitioners from the land.

Dealing with a lunch motion petition filed by Mekala Anjaiah and two others, claiming to be owners of a 6.2-acre land parcel in Khajaguda, Justice K Lakshman said, “What is the hurry in asking the owners to vacate the place within 24 hours, without a proper notice and without hearing the owners? I have to take a serious view on his conduct.” The judge also stayed the notices issued to the petitioners by HYDRAA on December 30. Directing HYDRAA to strictly follow the procedure, put the petitioners on notice, and hear them, the judge allowed HYDRAA to take action against the petitioners in line with the law and disposed of the matter.

During the hearing, the court questioned the authorities about the basis for concluding that the said property falls in the FTL of the water body. “Where is the final notification marking the FTL, and where are the notices to the petitioners (owners in possession)?” the judge questioned. When the authorities informed the court that the HYDRAA commissioner had conducted a personal hearing at the place with all the stakeholders, the petitioners’ counsel said that they did not receive any notices, let alone a personal hearing.

The judge further asked the counsels for GHMC and HYDRAA to furnish whether any final notification determining the FTL of the lake was issued or not.

GHMC counsel informed the court that the petitioners raised structures (fencing) without GHMC permission.
