Rajasthan HC lifts status quo on sealing of 19 buildings in Walled City, – Homevior

JAIPUR: A division bench of Rajasthan High Court Monday ended its status quo order issued on March 7 on sealing of 19 buildings deemed illegal for commercial activities in Walled City residential areas.

The bench of Chief Justice M M Shrivastava and Justice Bhuvan Goyal said that a coordinate bench had previously ordered these buildings’ sealing on Feb 25 and they cannot intervene in that order. The affected property owners may present their case to the original bench or appeal to the Supreme Court, the bench said. The building owners’ representatives argued that the Feb 25 order was based on an incorrect report that violated principles of natural justice. They requested time to review the order or challenge it in the Supreme Court, and the status quo be maintained till then.

The court said the Feb 25 order was of a division bench and the status quo order was also of a division bench similar to it. “Therefore, it cannot give order against the previous order,” the court said.
