Homebuyers Demand Action Against Developers for Project Delays Despite Rera Ruling, – Homevior

GURUGRAM: Homebuyers have alleged harassment and non-compliance by builders over a 2016 housing project, despite favourable rulings by the Haryana Real Estate Regulatory Authority (HRERA).

Buyers have alleged that builders have been charging them higher interests, blaming them for the delay in the project, even threatening them with cancelling their allotments.

The project, expected to be ready by 2021 is running late and allottees have claimed that over 80 percent of the flat’s cost has been paid.

Swadesh, an allottee, said, “After paying all the required amounts on time and waiting nearly eight years, the builder is blaming us for the delays. They are charging us unjust interest, and if we resist, they threaten to cancel our flats. We received a positive HRERA judgement, but the builder still refuses to comply, sending emails saying our flats are cancelled.”

In its recent order, HRERA directed the builder to reinstate cancelled units, issue fresh account statements, and pay buyers 11.10% annual interest on paid amounts for every month of delay since March 16, 2021.

The authority also mandated the builder to hand over possession within 60 days of obtaining the Occupancy Certificate (OC) and settle all arrears of interest within 90 days.

Buyers, however, are sceptical about the execution of the orders.

Another allottee, Anil Yadav, expressed, “We’ve paid over 85% of the flat cost and continue paying EMIs and rent. The builder cancelled our units despite the court order. When I visited their office, my phone was confiscated before meeting their staff, who threatened me to pay the interest or face prolonged legal battles.”
