Elderly Mumbai Couple Alleges Assault by Sons Over Property Dispute |- Homevior


Mumbai: A senior citizen couple from Malad has lodged a complaint of assault against two of their sons, one of whom is visually impaired. The couple told the police that they were verbally abused and beaten by their sons on various occasions as they had refused to transfer the ownership of their flat to their sons while they were still alive. Malad Police have registered an FIR for causing hurt and wrongful restraint under the Bhartiya Nyaya Sanhita, besides invoking provisions of the Maintenance and Welfare of Parents and Senior Citizens Act.
The couple own a flat at Malad West where they used to live with their two sons.They also have two daughters who are married and live separately. Their younger son is visually impaired.
According to their complaint, their older son and daughter-in-law moved out of the house in 2015 as they had refused to transfer the ownership of the flat to them. The older son claimed that he was the rightful heir to the property as his younger brother was unmarried and visually impaired. The couple clarified that after their deaths, the property would be divided among both sons.
According to the couple’s complaint, their older son and daughter would threaten them and refuse to look after them. Even after moving out of the house, the two would continue to visit the couple and fight with them over property rights. Lately, their younger son had also been demanding ownership of the property and was harassing them.
On June 3, both their sons manhandled them and pushed them out of the flat, even as their daughters tried to broker peace. Later, one of their daughters gave shelter to the elderly couple at her residence. The couple decided to approach the police recently, and an FIR was registered on Oct 08.
