THANE: Ulhasnagar Municipal Corporation (UMC) has decided to demolish a portion of an illegal under-construction 16-storey building in Ulhasnagar. The civic body has asked the developer to raze the structure, warning that if it is not done, action would be taken by UMC, and expenses recovered from the builder.
UMC’s decision has shocked flat buyers who have purchased flats in this building having 65 flats and 4 shops.
A similar issue of a 10-storey illegal building on a reserved garden plot in Kalyan had come to the fore recently.
In the Ulhasnagar case, the order passed by UMC, a copy of which is available with TOI, states that more than 50% of the building is built on the Development Plan roads from both sides. This includes a 120-foot DP road on the front side and an 80-foot DP road on the other side. In such a situation, although UMC has asked the developer to demolish the illegal portion of the building, technically, the entire structure will have to be demolished.
UMC’s order states that the former town planner was negligent while approving this building.
According to the order, the builder, Naresh Wadhwani of Jhalak Construction Company and his architect, while taking permission for construction, obtained permission without providing information about the DP road passing from both sides of the plot owned by Wadhwani.
